Approach to ADR

Mediation Focus

Mark S. Anshan is able to analyze complex disputes and identify their central issues. By establishing a common understanding of the issues, Mark facilitates the negotiation of settlement among the parties in a timely and cost effective way.

Mark’s approach to arbitration is to ensure procedural fairness throughout the hearing but avoiding formality to the extent possible. Arbitral decisions are well written and provided to the parties soon after the hearing is completed.

Mediation is the way to effectively communicate issues in conflict, identify the central interests and reach a settlement acceptable to the parties. Parties resort to arbitration if they are unable to mediate or determine that the best course of action is to have the matter adjudicated by an independent third party.

Organizational Change and Governance

Mark provides advice and facilitation for organizations undertaking structural changes including staffing and lay leadership models and governance review and revision.
